Digital Goa, Oct 14 – High Court has ordered the Judicial Magistrate First Class (JMFC) at Merces to decide the interim maintenance application, pending for 4 years, in a domestic violence case filed by a woman against her husband and in-laws by December 31, 2025. The court noted that the plea for interim monetary relief has been pending since the case was instituted on October 14, 2021.
The Court pointed out that the delay contravenes Section 12 of the Protection of Women from Domestic Violence Act, 2005, which requires such cases to be disposed of within 60 days of the first hearing.
Case load allotted to magistrates is very heavy : HC
While acknowledging the heavy workload of Magistrates, the Court requested the JMFC, Merces, to preferably decide the interim maintenance plea in the case by the end of this year i.e. by Dec 31. The petition was disposed of with the rule made absolute in these terms.
