Digital Goa, Jan 20 – Mapusa court has adjourned the hearing in the bail plea of Luthra brothers, Gaurav and Saurav in Birch fire incident case, to January 22. Their counsel concluded arguments in the matter, while the Assistant Public Prosecutor (APP) is scheduled to present submissions on the next date. During the hearing, the defence argued that Section 105 of BNS is not applicable as there is no case of culpable homicide. The counsel submitted that, at most, Section 125 of the BNS — which deals with rash or negligent acts endangering human life or the safety of others — could apply. Addressing concerns raised by the court regarding the brothers’ lack of roots in Goa, the defence assured that the accused are willing to remain in Goa for the duration of the investigation, comply with any conditions imposed by the court and be available for police interrogation. The fire incident at Luthra brother owned Birch by Romeo Lane at Arpora on Dec 6 had claimed 25 lives.
