Digital Goa, Nov – High Court has upheld the acquittal of MES Garrison Engineer Pravin Kumar in a 2002 CBI trap case, ruling that an alleged “hand gesture” was too vague to prove a demand for bribe of Rs 5,000. The court dismissed the CBI’s appeal, noting contradictions in witness testimonies — the complainant admitted no verbal demand was made, while the panch witness said he could not interpret the gesture and heard no demand. The court held that without clear proof of demand, recovery of money alone cannot lead to conviction under the Prevention of Corruption Act.
