High Court overturns JMFC’s reasoning, tightens bail terms for Dudu

Digital Goa, July 15 – High Court has upheld the bail of Israeli national David Driham alias Dudu, arrested by NCB in a cocaine seizure case, but set aside the reasoning adopted by a Mapusa JMFC while granting him relief. HC ruled that the Magistrate erred in holding that the arrest was invalid merely because the accused was not given a separate written copy of the grounds of arrest. It observed that Driham had acknowledged the grounds in writing and was fully aware of the allegations against him. Taking note that the accused has cooperated with the investigation and regularly attended trial since his release in June 2025, the Court allowed him to remain on bail. However, it imposed stringent conditions, including a ₹20,000 PR bond with local sureties, surrender of passport, restriction on foreign travel without prior permission, mandatory court appearances, and a direction not to influence witnesses or tamper with evidence.
