Dec 13- Supreme Court, led by Chief Justice of India, today asked Congress to approach the High Court against Speaker Tawadkar’s Nov 1,2024 order dismissing the 8 MLA disqualification plea. “We had earlier expressed a doubt as to whether the present special leave petition would be maintainable,” the Court observed in its order. The Bench asked Congress leader Girish Chodankar, who had filed the plea in the SC, to approach the High Court under Article 226 of the Constitution and granted him the liberty to request an expeditious hearing and disposal of the case. Senior advocate Manu Singhvi, representing Chodankar, argued that the Speaker delayed the decision on the disqualification petition by over 700 days, prompting the direct approach to the Supreme Court. Senior Advocate appearing for Congress sought permission to withdraw the present SLP and stated that the petitioner, Girish Chodankar, would approach the jurisdictional HC in the matter. “In view of the statement made, the special leave petition is dismissed as withdrawn with liberty as prayed for,” states the SC order.
