Supreme Court sends Baina beach beautification project case back to NGT for fresh hearing

Digital Goa, October 10 – Supreme Court has remanded the Baina beach beautification project case back to the National Green Tribunal (NGT) for reconsideration, allowing an appeal filed by the Goa Tourism Development Corporation (GTDC) against an earlier NGT order directing demolition of project structures and restoration of the beach to its original sandy condition. The NGT had earlier ordered GTDC to remove all structures and restore the beach to its original condition. The apex court found the NGT order cryptic, noting that it failed to clearly justify whether the project site was in a CRZ-I or CRZ-II area. “NGT has not discussed the materials and the evidence available on record and has jumped to the conclusion that area falls in CRZ-I restricted area, the order passed by NGT cannot be sustained,” stated the SC order. The Court, however, maintained the stay on the project, in force since 2014, and directed the NGT to hear the matter again on November 3, 2025
