Old Goa Structure: Supreme Court says HC should have relegated matter to ASI instead of quashing demolition order

Digital Goa, Sept 9 – Supreme Court has issued a notices to the respondents in a Special Leave Petition filed by the Save Old Goa Action Committee in the allegedly illegal bunglow in heritage zone at Old Goa, assailing an order passed by the Bombay High Court. The HC had set aside an order passed by the Archaeological Survey of India (ASI) to demolish the under construction house, in the UNESCO heritage zone at Old Goa citing violation of natural justice principles. The Apex Court, while issuing notice, expressed concerns about the High Court setting aside the said matter prematurely instead of remitting the matter back to ASI for re-consideration. On August 16, 2022, Director General, ASI, had ordered the removal of the said house under Section 19(2) of the Ancient Monuments and Archeological Sites and Remains Act, 1958. High Court had set aside this order by ASI.
