Digital Goa, July 15 – In a significant development in the June 2022 Prof Gauri Achari murder case, the High Court has discarded the supplementary chargesheet filed against accused Gaurav Bidre, ruling that it was submitted without the mandatory prior permission of the Magistrate as required under Section 173(8) of CrPc, informed accused Gaurav Bidre’s counsel Rohan Desai. High Court also set aside a Sessions Court order that had upheld the supplementary chargesheet, holding that the investigating officer could not carry out further investigation and file additional material before the court without first obtaining judicial approval. The order effectively excludes from the trial all material collected during the subsequent investigation, including the test identification parade (TIP), call detail records, forensic analysis of seized mobile phones and supplementary witness statements. The prosecution will now likely have to proceed with the trial on the basis of the original chargesheet filed by the Old Goa Police. The ruling is expected to have a significant bearing on the prosecution’s case. Fitness trainer Gaurav Bidre, is accused of the murder of 35-year-old college assistant professor Gauri Achari at Old Goa in June 2022.
