Digital Goa, July 17 –Citizens’ movement Enough is Enough, Goa (EIE) on Friday submitted a memorandum to the Chief Town Planner demanding that the State Government scrap Section 39A of the Goa, Daman and Diu TCP Act, 1974, and immediately halt all further notifications under the provision until the High Court decides on its constitutional validity. The movement gave the Government a 15-day ultimatum, warning that it would intensify its agitation if its demands were not met. EIE leaders also said they would seek the resignation of the TCP Minister if the Government failed to act within the stipulated period. EIE alleged that Section 39A has become the primary mechanism for dismantling the Regional Plan 2021 through individual plot-by-plot zone conversions. According to the memorandum, the Town and Country Planning Board has already recommended 811 applications under Section 39A, involving over 51 lakh square meters of land proposed for conversion from Eco-Sensitive Zones to Settlement Zone. 279 recommendations have been finalised, resulting in approximately 29.27 lakh square meters of land already converted. Of these, 258 final notifications were issued despite detailed objections filed by citizens and local groups. The organisation also raised objections to the proposed notification of around 2 crore square metres as “Non-Developable Area”, claiming the category has no statutory basis under the TCP Act or RP 2021. It sought complete transparency in the process, publication of a public register of all Section 39A applications, and a written response from the Department within 15 days. EIE said it would pursue all available legal remedies if fresh notifications continue to be issued while the matter is pending before the High Court.
